In re Philips Recalled CPAP, Bi-Level PAP, and Mechanical Ventilator Products Liability Litigation (MDL 3014)
This is the Preservation Registry website for MDL 3014, In re Philips Recalled CPAP, Bi-Level PAP, and Mechanical Ventilator Products Liability Litigation.
The parties in this case stipulated to, and the Court entered, a Preservation Order that requires Philips RS to create this Preservation Registry.
Who Should Use This Registry:
Owners or users of recalled DreamStation 1 devices who would like to have Philips RS preserve their recalled DreamStation 1 device if you have filed a lawsuit or may file a lawsuit in the future; or
Owners or users of recalled Trilogy devices who would like to have Philips RS preserve the foam and airpath components of their recalled Trilogy device if you have filed a lawsuit or may file a lawsuit in the future; or
Owners or users of recalled DreamStation 1 devices who will self-preserve their DreamStation 1 device for purposes of a lawsuit; or
Owners or users of recalled Trilogy devices who would like to self-preserve their Trilogy device for purposes of a lawsuit.
NOTE: This registry’s purpose is to provide users the option of requesting preservation of their recalled Dreamstation 1 device or preservation of the foam and airpath components of their recalled Trilogy device for purposes of a lawsuit. Participation in the Preservation Registry is not a request for Philips RS to replace or rework your DreamStation 1 or Trilogy device. To ask Philips RS to replace or rework your DreamStation 1 or Trilogy device, you must register separately through Philips RS’s recall registration website:

Participation in the Preservation Registry is optional. If you do not participate in the Preservation Registry, your returned device may be modified by Philips RS pursuant to Phillips RS’s recall remediation plan submitted to the FDA.
Participation in the Preservation Registry does not determine whether or when a replacement device will be provided to a user pursuant to the recall. A user must still request a replacement device from Philips RS through its recall and remediation process at the link specified above. Upon receipt of a replacement device, you will receive a prepaid and pre-addressed return label for return of the recalled device to Philips RS.
For Owners or Users of DreamStation 1 Devices
Participation in the Preservation Registry does not determine whether or when a replacement DreamStation 1 device will be provided to a user pursuant to the recall. A user must still request a replacement DreamStation 1 device from Philips RS through its recall and remediation process at the link specified above. Upon receipt of a replacement device, you will receive a prepaid and pre-addressed label for return of the recalled DreamStation 1 device to Philips RS.

For Owners or Users of Trilogy Devices
Participation in the Preservation Registry does not determine whether or when an owner or user’s Trilogy device will be reworked by Philips RS and returned to the owner or user. An owner or user must still request that Philips RS rework the Trilogy device and return it to the owner or user through Philips RS’ recall and remediation process at the link specified above. Owners or users of Trilogy devices will receive instructions from Philips RS for returning their Trilogy devices to Philips RS for rework.

To be included on the MDL 3014 Preservation Registry, please select one of the two available methods described below.

Register by filling in the spreadsheet template and then sending as an attachment to MDL3014PreservationRegistry@morganlewis.com. The spreadsheet template allows for registering multiple devices at the same time. Please note: any modifications made to the Excel template (such as adding/removing columns or converting the file to PDF format) will result in failure to process the submission.
